Terms of Submission to RIP Madeira

1. Legal Entity & Jurisdiction

This website is owned and operated by Delicious Code Lda (NIF 516904620), headquartered in Funchal, Madeira. By using this service or submitting a notice, you agree that these terms are governed by the laws of Portugal. Any legal proceedings shall be subject to the exclusive jurisdiction of the courts of Funchal, Madeira.

2. User Responsibility & Factual Accuracy

RIP Madeira is a digital hosting platform for community memorials. The person submitting a notice (the “Uploader”) holds 100% legal responsibility for the content provided.

• Accuracy: The Uploader warrants that all names, dates, and funeral arrangements are factually correct. RIP Madeira does not independently verify these details.
• Authorisation: By submitting, the Uploader confirms they have the express consent of the deceased’s next of kin to publish the notice and any accompanying images.
• Indemnity: The Uploader agrees to indemnify and hold Delicious Code Lda harmless against any claims, damages, or legal costs arising from unauthorised or inaccurate submissions.

3. Prohibited Content & Editorial Standards

To maintain the dignity of our platform, RIP Madeira strictly prohibits the following in any Death Notice or Tribute:

• Commercial Advertising: You may not include business links, phone numbers, or promotional text (e.g., “Flowers provided by [Shop Name]”) within a standard notice unless you are a registered Paid Partner.
• Respectful Conduct: No political statements, defamatory remarks, or language intended to incite conflict will be tolerated.
• Privacy: Do not include private home addresses or personal phone numbers of living family members without their explicit consent.
• Right to Refuse: RIP Madeira reserves the right to edit or remove any content that violates these standards or is deemed disrespectful.

4. Image Rights

Uploaders must own the rights to any photos submitted or have permission from the photographer. RIP Madeira is not liable for copyright infringement by users. We reserve the right to crop or resize images for technical optimisation.

5. Payments & Refund Policy

• Service Completion: In accordance with EU Consumer Law, the 14-day right of withdrawal does not apply to digital services that are “fully performed” upon publication. Once a notice is live, the service is complete.
• Refunds: No refunds are issued for published notices.
• Corrections: Factual errors (typos, date changes) will be corrected free of charge. Please Contact Us or send requests to our Email.

6. Business Directory & Partners

• Annual Billing: Partner listings for funeral homes and florists are billed annually or by monthly subscription.
• Termination: You may cancel your subscription at any time; however, no partial refunds will be given for the remaining months of the billing cycle.
